Skiberry

Terms of Service

These terms are an agreement between you and Skiberry ("Skiberry", "we", "us"), the music-making web app at www.skiberry.com. By signing in or using Skiberry you agree to them. If you don't agree, please don't sign in or use the service.

1. What Skiberry is

Skiberry is a tool and a platform. We give you instruments, a piano roll, a mixer and ways to save, export and share your music. We don't create, review or approve what you make. You decide what you create, upload, export, share or publish, and you are responsible for it.

2. Your account

3. Your content belongs to you

You keep ownership of the songs, recordings, MIDI and other material you create or upload ("your content"). You give Skiberry a non-exclusive, worldwide, royalty-free license to store, copy, process and display your content only as needed to run the service for you: saving your projects, opening them on your devices, rendering exports and showing content you choose to share. This license ends when you delete the content or your account, except for copies in routine backups that are deleted over time.

4. Your responsibility for your content

5. Things you must not do

6. Indemnity

You agree to defend, indemnify and hold harmless Skiberry and the people who run it against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising from your content, your use of Skiberry, or your breach of these terms or of anyone's rights.

7. Reporting infringement and impersonation

If you believe content on or shared through Skiberry infringes your rights or impersonates you, email a2kmediagroup@gmail.com with:

We acknowledge complaints within 24 hours and resolve them within 15 days, as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We may remove or disable access to content, and suspend accounts, at our discretion. Accounts that repeatedly infringe will be closed. If your content was removed and you believe that was a mistake, you can reply to us with your explanation.

8. Bundled sounds

The piano and drum samples that come with Skiberry are public domain (CC0). You may use them in your music, including commercially. This doesn't cover material you add yourself.

9. Suspension and ending

You can stop using Skiberry at any time and ask us to delete your account. We may suspend or end your access, or remove content, if you break these terms, if the law requires it, or to protect Skiberry or other people.

10. The service is provided as is

Skiberry is provided "as is" and "as available", without warranties of any kind. We don't promise it will be uninterrupted, error-free or that your data will never be lost. Keep your own copies of important work (you can export projects, audio and MIDI at any time).

11. Limitation of liability

To the fullest extent the law allows, Skiberry and the people who run it are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and are not liable for content created, uploaded or shared by users. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or zero if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.

12. Governing law and disputes

Skiberry is operated from India. These terms are governed by the laws of India, including the Information Technology Act, 2000 and the rules made under it. Any dispute arising out of these terms or your use of Skiberry is subject to the exclusive jurisdiction of the courts of India. If you use Skiberry as a consumer outside India, nothing in these terms takes away the protections that the law where you live gives you and that cannot be waived by contract. Before going to court, please contact us so we can try to resolve it informally.

13. Changes

We may update these terms. When we make changes, we'll update the version date above and ask you to agree again the next time you sign in. If you don't agree to the new terms, stop using Skiberry.
